I have my H1 filed in 2008. Due to the market situation, I didn't go for H1 stamping and entered US in March 2009 on H4.
I would like to know the steps/process for H4 -> H1 COS.
I know my employer is the best person to answer this. But, the problem is whenever I ask any details, he always tries to abstract the info.
If there are sequence of steps, after which step one is authorized to work? I tried getting the info online, but couldn't . If any of you can give me a pointer or explain the process in detail, it would be very great and helpful.
As per my employer, I can start working in 2 weeks after he initiates the process. I want to make sure that I don't run into any legal issues. Once the employer has initiated the COS process, is there a way one can track the status and also to verify the status after the completion of the process.
Sorry for too many questions. But, please please do help!!!

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

When my wife went to get her H-4 stamped, I gave her my original I-797. I think the applicant need to carry the original I-797 document with them for the interview...

I am purchasing tickets to INDIA in an hour. Haven't thought about this much until one of my friends asked me this. My priority date is March 2005. I am planning to travel to INDIA using AP in December last week and come back in first week of Feb 2010. IF my GC gets approved during my stay in INDIA, would it a problem while coming back or if an RFE is issued, would it be a problem.

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

If my priority date is current based on March visa bulletin, till what date can I file for my 485? Do I have time until end of April?
You can file anytime after your dates are current.. Just don't take too long though, Remember if the dates retrogress again, then might get out of luck! Again!! So file it right away if you can...
