Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.

Now things are not predictable. I prefer premium process with an extra 1000 USD
If you want to travel, yes you should go.

Sir/Mam,
I am was in US on H4. I am currently in my home country for vacation.
While here, I got my H1B applied and approved as consular processing for 2011 cap.
I plan to go back to US in August on H4 and then apply COS in October and start working.
My question is : Since my H1 was approved while I was out of US, will my COS also be approved as consular processing only? Do I have to go for stamping again before I could start working???
Also, if I decide to wait and get my H1 stamped in my home country, what is the earliest I can go to stamping for 2011 cap? Can I land in US on H1B sometime mid September and start working from October.

Senators John Kerry (D-MA), Richard Lugar (R-IN) and Mark Udall (D-CO) have reintroduced the start up visa bill now that the new Congress is in session. The bill would grant two-year visas to entrepreneurs if they secure $100,000 from qualified investors. After two years, the start up must have at least five employees and $500,000 invested. Democrats and Republicans have talked endlessly that the focus in Washington should be on job creation, but for the most part little has been done. The start up visa is a way to directly create jobs and costs the taxpayers nothing.

New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. My post regarding calling up the members after registration has apparently disturbed some members, first let me apologize for that and for some postings regarding that matter. The calling option was ONLY intended to ward of unwanted and vicious members using this forum to work against our goals.
I understand that a lot of non-indians are in this forum(for instance, Greg Siskind quotes from these forums a lot), and my post could be interpreted as being against non-indians, but it was not the intention.

If you can wait for AP to get approved that would be a better choice. When did you applied for AP? I know couple of my friends whose AP got approved with in a month. It all depends on case to case. Don't take it granted as 2-3 month.

My wife was on f1 status when we filed for 485.
We went to india this last december and used AP, no issues what so ever.
Make sure you do provide the old 94 to airlines before leaving US.

Domicile Certificate i.e. Certificate of nationality shows the date of birth.Can this be used instead of Birth Certificate?

The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.

My friend is an F1 student (citizen of India) who has been in the US for 3 years as a grad student. She has paid US taxes on stipend/fellowship received from US university while pursuing grad studies (filing taxes as a non resident in US, since the first 5 years on F1 are not counted towards substantial presence test).
Does she need to also pay taxes on this stipend in india, or report this income in india? AFAIK, no taxes need to be paid in India on this US stipend, but I couldnt find any authoritative reference online.
Am asking, since someone I know recently got a letter from IT dept in india saying that the US authorities reported $10K of income when that person was a student (this was a fellowship from the university) - and the letter goes on to ask the person to meet someone at the indian IT department.
